Benjamin M. Lopatin
Benjamin M. Lopatin is a skilled attorney who is dedicated to the zealous advocacy of his clients and takes pride in fighting for justice for consumers. Mr.Lopatin focuses his practice on civil litigation, primarily involving class actions,consumer protection, unfair competition, false advertising, product liability, food law, and privacy law. Mr. Lopatin also has experience handling matters involving personal injury, intellectual property, family law, and contract law.
Benjamin Lopatin was born and raised in Rochester, New York, and he now resides in San Francisco, California with his wife. Mr. Lopatin is a 2005 graduate from the State University of New York at Buffalo, where he received his Bachelor of Science in Business Administration.
Mr. Lopatin then graduated in 2009,cum laude, with his Juris Doctorate, from the Shepard Broad Law Center at Nova South eastern University, in Fort Lauderdale, Florida. Mr. Lopatin was privileged to receive an honors award at graduation for his outstanding pro bono service in the community. During law school, Mr. Lopatin served as the Marketing Editor for Nova Law Review, and on the executive boards for several organizations at Nova, including the American Association for Justice, Phi Alpha Delta, Criminal Law Society, Native American Law Students Association, and Florida Association for Women Lawyers, along with being a Student Advisor.
In addition, Mr. Lopatin served as a Research and Teaching Assistant for Professor Kimberley Hausbeck, where he assisted first year law students in the area of legal research and writing, and provided research and editorial assistance to Professor Hausbeckin a published article, The Little Engine That Could: The Success of the Stewardship Contracting Authority, 32 Wm. & Mary Envtl. L. &Pol’y Rev. 33 (2007). Mr. Lopatinalso participated in Nova’s Children and Families Civil Law Clinic, where he gained valuable experience in civil litigation and family law, by working as a Clinical Legal Intern at a prestigious law firm that exclusively handled family law matters, primarily involving dissolution of marriage and custody issues.
After law school, Mr. Lopatin decided to further his scholarly background and graduated from DePaul College of Law in 2011, with his Master of Laws (LL.M.) in Intellectual Property, where he was selected to be a member of the Phi Kappa Phi honors society.
Mr. Lopatin’s work experience includes working as a legal intern for Legal Aid Services of Broward County, and working as a law clerk for a prestigious personal injury law firm in Miami.
Mr. Lopatin then decided to focus on helping obtain justice for consumers by working at a class action law firm, where he was promoted to Managing Partner. Mr. Lopatin has litigated numerous consumer protection class actions, and was approved as being Class Counsel in the following cases: Rappaport v. Jamba Juice Co., No.: CGC-12-521091 (San Francisco Superior Court) (consumer protection class action regarding misleading advertising of Jamba Juice beverage additive); Klacko, et al v. Diamond Foods, Inc., Case No. 14-80005-BB (S.D. Fla) (consumer protection class action regarding Kettle Chips labeled as being “All Natural” but containing unnatural, synthetic, artificial, and/or genetically modified ingredients); and Moore v. GNC Holdings, Inc., No. 12-61703 (S.D. Fla.) (consumer protection class action regarding failure to warn of known dangers on the labeling of a supplement).
After obtaining valuable experience and a vast amount of knowledge inconsumer protection and privacy class actions, Mr. Lopatin co-founded Eggnatz, Lopatin & Pascucci, LLP, which strives to achieve justice in the consumer marketplace.
